I serve you in pursuit of your goals. We live in a time of stardom, super-stardom and mega-stardom, so that first sentence probably sounds like it belongs in some other century, but no legal matter is about the lawyer. When your lawyer starts putting on a show to impress you or others, your goals can get lost in the shuffle. That does not and will not happen here; obscurity is okay by me. Besides, given a choice between brilliant and lucky, I would much rather have people think of me as lucky. Nobody likes a know-it-all and lucky never made anyone's ears hurt.
Sometimes, our best efforts lead to nothing in the legal system, but more often than most people think, we control our own fates. Assuming all the evidence can be found and presented wisely in a fair hearing, we can still wander into disaster when we mess up the basics. One of the advantages of an active practice is in being around on a regular basis to see others mess up. Not having to make every mistake for myself and for my clients has saved a lot of wear and tear on all of us. And I have seen some horrible disasters, not only in lawsuits, but in transactions and negotiations as well.
Remember that first sentence up there? As your lawyer, I have to advise you about what goals are within the realm of possibility, but in the end, it is always your privilege to select your goal and to change that goal if the situation calls for change. It would be incredibly arrogant for an attorney to select the goal simply because it is a goal the attorney knows he or she can accomplish, so in the end, we may talk about many possibilities, but you decide what you want to accomplish.
Finally, this is as good a place as any to mention that, much as I would like every problem to have a simple solution, a lot of variables can affect your situation, so I will not give off-the-cuff legal advice. Following generic legal advice can only solve a problem by accidental coincidence, and I do not take foolish chances. Besides, slick, uninformed opinions are just so much noise, and there is already plenty of noise to go around.
